ORDINARY ORIGINAL CIVL JURISDICTION WRIT PETITION NO.93 OF 2014 ________________________________________________________________________ Office Notes, Office memorandum of Coram, appearances, Court's Court's or orders or directions & Judge's orders.

Registrar's orders.

Shri. Anil Mishrafor the Petitioners.

Mr. Vijay D. Patil for Respondent No.3.

CORAM :

A.S. OKA & A.P.BHANGALE, JJ.

DATED : 07 April, 2015 P.C.:

Heard learned counsel appearing for the petitioners and the learned counsel appearing for the third respondent. Perused the letter dated 18 September 2012. The petitioner claims to be in possession of the plot bearing CTS No.86/part. The letter dated 18 September 2012 records that scheme in relation to the said plot has been kept in abeyance till the developer obtains proper title.

2) It is obvious that if SRA scheme is approved, before its implementation on CTS No.86/part of Village Mogra, the petitioner will have to be heard. 3) As far as the apprehension regarding the acquisition of the said plot is concerned, it is obvious that the acquisition cannot be made without following the

asn due process of law.

4) Therefore, subject to what is observed above, no case is made out for interference at this stage. Petition is disposed of.
