Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

The name of Respondent No. 3 stands deleted from the cause title and therefore the question of granting reliefs against Respondent No. 3 does not arise.

ii. The disputes and differences between the Applicant and Respondent Nos. 1 and 2 arising out of the Memorandum of Understanding dated 26th September, 2006 are referred to the sole Arbitration of Mr. E.P. Bharucha, Senior Advocate.

Nitin 1022-ARBAP-286-2014 iii. The parties and their Advocates shall appear before the learned Arbitrator in his chambers, on 6th February, 2015 at 5.00 p.m. and obtain necessary directions.

iv. The learned Arbitrator shall endeavour to pass his Award within a period of six months from the date of the first meeting held by him with the parties and their Advocates.

v. The cost of arbitration shall initially be borne by the parties equally. vi. All contentions of the parties are kept open. vii. The venue of Arbitration shall be at Mumbai. The above Arbitration Application is accordingly disposed of. (S.J. KATHAWALLA, J.)
