Defendant Nos.2 to 4 are members of the managing committee of Defendant No.1 Co-operative Housing Society. Learned Counsel for the Plaintiff states that the suit is not being pressed against these Defendants. Learned Counsel requests the court to take consent terms on record and grant relief to the Plaintiff to withdraw the suit unconditionally in terms of the consent terms. Consent terms are taken on record, marked 'X' for identification. The suit is dismissed as not pressed against Defendant Nos. 2 to 4 and the Plaintiff is permitted to withdraw the suit as against Defendant No.1 unconditionally in terms of the consent terms.
