By my order dated 4th December, 2018, it was recorded that both the parties, namely, the Petitioner and Respondent No.1 had agreed that the panel of three Arbitrators that was already appointed, was to be substituted by a Sole Arbitrator. Both the parties had further agreed that the Sole Arbitrator would be Justice S.J. Vazifdar (Retired Chief Justice of Punjab and Haryana High Court). This matter was kept today for the Petitioner to file the disclosure statement of the learned Arbitrator as contemplated under Section 11(8) read with Section 12(2) of the Arbitration and Conciliation Act, 1996. Today the disclosure statement of the Pg 1 of 2
2.carbp.472.2017.doc Arbitrator has been filed and is taken on record and marked "X" for identification.
In view of this the Arbitration Petition stands disposed of. No order as to costs.
It has also been brought to my notice that there are certain typographical mistakes in paragraph 5 of the order dated 4th December, 2018 which need to be corrected.
In second line of paragraph 5, substitute the words "Section 11(6)" with the words "Section 11(8)". Similarly in the second last line of paragraph 5, the words "six weeks" shall be substituted with the words "six months". The rest of the order dated 4th December, 2018 shall stand as it is. The corrections be carried out in the original order as well as in the order uploaded on server. (B.P.COLABAWALLA, J.) Pg 2 of 2
