ORDINARY ORIGINAL CIVIL JURISDICTION WRIT PETITION NO.2166 OF 2016 Mr. Cosme Matias Joaquim Rodrigues ..Petitioner

Versus

The Regional Passport Officer Mumbai and another ..Respondents Mr. O. Mohandas a/w Ms. Rima Desai i/by Ms. Rajalakshmy Mohandas for the Petitioner.

Mr. Jaydeep Deo for the Respondents.

CORAM : R. M. SAVANT & SMT. SADHANA S. JADHAV, JJ DATE : 6th JULY, 2017 P.C.

The only relief sought by way of the above Petition is a direction to the Respondent No.1 to correct the date of birth of the Petitioner mentioned in his Passport. The date of birth mentioned in the Passport of the Petitioner is "16.08.1952" which the Petitioner wants to get changed to "16.03.1952". In terms of the earlier guidelines, such a change could not be effected unless the change was effected in the Passport which was originally issued to a party. However the guidelines have undergone a change and now such an application could be entertained. The said fact has been mentioned in the Affidavit dated 04.07.2017 of one A. B. Seetha Ramchandran, Assistant Passport Officer BGP.

filed on behalf of the Respondents especially in paragraph 8 thereof. In view of the change in guidelines, there is now no impediment for the request made by the Petitioner from being considered. We therefore direct the Respondents to consider the said request of the Petitioner for change of date of birth. The same to be done expeditiously. The Petitioner to make an application within two weeks from date. On receipt of the said application, the same to be considered and disposed of by the concerned Passport Officer within six weeks thereafter. With the directions as aforestated, the Writ Petition is disposed of. [SMT. SADHANA S. JADHAV, J] [R.M.SAVANT, J] BGP.
