The defendant admits the contents of the Consent Terms, 'X', which were taken on record on 24th November, 2021 and also the execution thereof. The defendant is identified by the learned Counsel for the defendant.

Upon being specifically inquired, the defendant submits that he is voluntarily submitting to a decree to be passed in 1/2

In view of the above, the suit stands decreed in terms of prayer Clauses (a) and (b) in accordance with the Consent Terms ('X').

5.

The Consent Terms shall form part and parcel of the decree.

6.

The undertakings given in the Consent Terms are accepted as undertakings to the Court.

7.

The plaintiff is entitled to the refund of court-fees as per the Rules.

8.

The Court Receiver stands discharged without passing accounts, subject to payment of charges by the plaintiff. 9.

Court Receiver's Report No.434 of 2021, stands disposed of.

10.

Leave Petition (L) No.21270 of 2021 stands allowed. 11.

In view of disposal of the suit, Interim Application No.21269 of 2021 stands disposed of.
