The petitioners are seeking issuance of Legal Heirship Certificate under Section 2 of the Bombay Regulation Act (VIII) of 1827 with respect to one M. Selvakumar, who expired on 28.01.2007. It is stated that the petitioners are the only legal heirs being the widow and son of the said deceased. The petitioners have also applied for Succession Certificate under Part X of the Indian Succession Act, 1925 which came to be issued on 23.12.2016.

The petitioners have taken out this Misc. Petition for issuance of Heirship Certificate for the purpose of satisfying the rationing Waghmare 1/2

19. MPT.22.17 .doc authorities. The petitioners have also stated that they have not filed any other Petition for issuance of Legal Heirship Certificate. Since the petitioners have already obtained the Succession Certificate, I see no impediment in granting the relief has sought. Therefore, the Petition is made absolute in terms of prayer clause (a) in favour of Mrs. Indira Selvakumar and Mr. Senthil Selvakumar. Petition is accordingly disposed.
