This Petition is under Clause XII of the Letters Patent. The proposed Suit is for partition of the share, right, title and interest in the estate of one Paramjit.

The major properties of which partition is sought are situated in Mumbai i.e. within the jurisdiction of this Court. The Plaintiffs seek major relief against the Defendants No. 1 to 3 who are residing within the jurisdiction of this Court. The Defendants No. 4 to 1 / 2 September 9, 2019

6-LPETN-144-19.doc 6 against whom relief is not claimed are situated outside Mumbai. Two properties are also situated outside the jurisdiction of this Court. 3.

I am satisfied that the material part of cause of action has arising within the jurisdiction of this Court. Accordingly, leave is granted under Clause XII of the Letters Patent. This Court will have jurisdiction to entertain and try the Suit.
