The learned counsel appearing on behalf of the Petitioner brought to the attention of the Court that the disputes between the parties have been settled as recorded in the Consent Minutes of the Order dated 25th October, 2021 and the same are tendered before the Court today. The Consent Minutes of Order are signed by one Mr.Kailash Bankar on behalf of the Petitioner society and by Mr. Aswale 1/3

Pragand Ketkale, the Assistant Manager-Legal of Mumbai Telecom Circle. Both the aforesaid persons have been authorized to sign the Consent Terms. Mr. Kailash Bankar and Mr. Pragand Ketkale both are also present in Court today. They have stated before the Court that they have signed the Consent Minutes after reading and understanding the same as well as the implications thereof. The Consent Minutes have also been signed by the advocates for the Petitioner. Since the Respondent is not represented by any advocate, no advocate has signed on behalf of the Respondent.

In these circumstances, the Consent Minutes of Order dated 25th October, 2021 are taken on record and marked "X" for identification. There shall be an order in terms of the Consent Minutes of Order. The undertakings given in the Consent Minutes of Order, if any, are accepted as undertakings given to the Court. The Respondent who is present in Court as well as the advocates for the Petitioner have both stated that these Consent Minutes of Order resolve the entire disputes between the Petitioner and the Respondent, and therefore, there is no requirement to go for arbitration. It is accordingly so ordered.

The above Section 9 Petition is accordingly disposed of. No Aswale 2/3

order as to costs.
