The present appeal relates to Assessment Year 2001-02. 2.

The learned Counsel for the appellant fairly concedes that in respect of similar issue and same assessee for A.Y. 1997-98, the department had filed Income Tax Appeal No.1560 of 2013 and the same has been dismissed on 7th July, 2015.
