Ms Sakhalkar states that the chamber summons is for leave to continue the suit against defendant no.1, by bringing on record the official liquidator. Defendant no.1, it is stated, was ordered to be wound up by an order dated 19th January 2018. Leave sought is under Section 446 of the Companies Act, 1956 and that leave has to be obtained from the Company Court.

Therefore, chamber summons is allowed to be withdrawn with liberty to apply to the Company Court for leave under Section 446 of the Companies Act.

Chamber summons disposed.
