The Petition is for leave under Clause XII of the Letters Patent. The proposed is for recovery of price of goods sold and delivered. The Respondents is presently in Thane although at the relevant time it had an office in Mumbai. Besides, a material part of cause of action has arisen within the jurisdiction of this Court. With leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to try and entertain the suit. 2.
