Mr.Behramkamdin for plaintiff states that the notice of motion has been adjourned to be heard along with the suit vide order dated 13th July 2015. Mr.Behramkamdin states and rightly so that if the suit itself is decided, there will be no reason to argue the notice of motion. In view of above, I see no reason why the notice of motion should be kept pending particularly considering the prayers sought in the notice of motion.

Notice of motion accordingly disposed.

The suit be listed for further evidence/marking of documents on 8th September 2017.
