927-CA1030-15.DOC Shephali
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
ORDINARY ORIGINAL CIVIL JURISDICTION COMPANY APPLICATION NO. 1030 OF 2015 IN OFFICIAL LIQUIDATOR'S REPORT NO. 385 OF 2014 IN COMPANY PETITION NO. 31 OF 2011 Rajesh Bhattad (M/s. A to Z Stell Forge Ltd.) ...Applicant
Versus
M/s. Sehgal Fine Forg Pvt. Ltd. & 1 Anr.
...Respondents
None for the Applicant.
Mr. Manoj Angre, i/b Mr. Girish Kedia, for original Petitioner. Ms. Yogini Chauhan, Dy. Official Liquidator, present. CORAM: G.S. PATEL, J DATED:
17th March 2016 PC:- 1.
Mr. Angre points out that this Application is not maintainable. By order dated 27th February 2015 (Mr. Justice S.J. Kathawalla), a purported sale by the Company, Sehgal Fine Forge Private Limited, of certain immovable properties to A to Z Steel Forge Limited, having purportedly been executed after the date of winding up, was held to be void and not saved under Section 536 of
927-CA1030-15.DOC the Companies Act, 1956. A copy of this order is at Exhibit "A" to the Affidavit in Support of this Company Application. 2.
The present Application is by one Mr. Rajesh Bhattad on behalf of A to Z Steel Forge Limited seeking that the order dated 27th February 2015 passed by Hon'ble Mr. Justice S.J. Kathawalla be 'quashed' (presumably recalled) and set aside; and that the Applicant be allowed to deposit the claims of the creditors/Respondents and for other interim reliefs. 3.
The entire action is misconceived. It is difficult to say whether this is a review petition, a mercy petition or an appeal. I can entertain none of these.
4.
The Company Application is dismissed. There will be no order as to costs.
