Mr. Goenka for plaintiff seeks leave to withdraw the suit. Mr. Goenka states that Liquidator has been appointed for the owner of defendant no.1, Varun Resources Ltd, who is defendant no.3 in the suit, by NCLT Mumbai. Mr. Goenka seeks leave to pursue the claim in the NCLT, Mumbai.

The suit dismissed as withdrawn with liberty as prayed for. If the claim is filed within four weeks from today, the Liquidator shall consider their claim and shall not reject the same as being beyond the period mentioned in his notice.
