Learned Counsel appearing for the Respondent-Maharashtra Pollution Control Board ("MPCB"), state that in the interregnum and after fling of the present petition, the premises of the Petitioner were inspected and unit was found to be totally in compliance with the requirements of the statutory provisions of the Act as also consent to operate Order granted in favour of the Petitioner.

In that view of the statement having been made, the Order impugned dated 23 August 2019 is set aside and the Petition is allowed accordingly.
