Mr.Saxena appearing for plaintiff seeks leave to withdraw the suit since the owners of defendant no.1 is in liquidation proceedings before the NCLT, Mumbai. Counsel also seeks liberty to lodge their claim with the Liquidator.

Suit dismissed as withdrawn with liberty as prayed for. Liquidator shall consider the claim if lodged within 4 weeks from today even if time to lodge the claim has expired. Refund of court fees if any, in accordance with Rules.
