The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit is for a declaration of title by adverse possession. The property is situated in Mumbai. Defendant No. 4 is outside the jurisdiction of this Court. A material part of the cause of action has arisen within the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit. 2.

This is without prejudice to all rights and contentions and in particular to the issue of whether a suit for a declaration of this sort is maintainable.
