The Petitioners are seeking appointment on compassionate basis with the Respondent No. 2. Learned Counsel for the Respondent No. 2 states that the Respondent No. 2 is amenable to the jurisdiction of the Central Administrative Tribunal.

In the light of law, laid down by the Constitutional Bench in the L. Chandra Kumar vs Union of India1 the Administrative Tribunal in such service dispute would be the Court of first instance. 3.

Keeping all contentions of the Petitioners open, the Writ Petition is disposed.
