The petition seeks legal heirship certificate under Section 2 of the Bombay Regulation VIII of 1927. The certificate is sought for claiming 49% share of the deceased in the Petrol/Diesel Dealership agreement of HPCL. All legal heirs and next of kin of the deceased other than the Petitioner herein have consented to issuance of legal heirship certificate in favour of the Petitioner without service of citation or proclamation. The petition was accepted accordingly on 14 November 2017 and issue of proclamation was dispensed with. This Court is satisfied on the basis of the averments made in the petition and documents submitted therewith about the claim of the Petitioner to the legal heirship of the deceased. Accordingly, misc. petition is allowed.
