The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit is in respect of a lease agreement in regard to an immovable property at Andheri. The proposed Defendants Nos. 3, 4 and 5 are outside the jurisdiction of this Court. A material part of cause of action has arisen within the jurisdiction of this Court, where the immovable property is situated. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit.
