The proposed Suit is an action in infringement combined with a cause of action in passing off. Defendants Nos. 1 and 2 reside outside the jurisdiction of this Court. However, a material part of cause of action having arisen within the jurisdiction of this Court, I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
