1) Rule. Rule is made returnable forthwith. Heard finally by consent of parties.
2) The learned Counsel appearing for the petitioner has made a statement that their application filed on 11th February, 2017 is pending with DRT-I and the next date is on 4th October, 2017. An apprehension is raised and which is confirmed that the matter is fixed on 25th September, 2017 for taking possession by the Commissioner appointed by the learned Chief Metropolitan Magistrate, Mumbai. Therefore, at this stage, by keeping all defences open, including the contentions, we are inclined to dispose of the present writ petition, however, with the direction that the DRT-I to decide the application of the petitioner on 4th October, 2017 itself. In the meantime, to avoid further complications and in the interest of justice, the respondents not to take further steps for taking possession till 5th October, 2017.
