This Petition is filed for leave under clause XII of the Letters Patent. The proposed Summary Suit is for a monetary decree against the Defendants jointly and severally. Defendant No.2 is carrying on its business within territorial limits of this Court. 33 invoices in respect of which the monetary decree is sought was raised by the Plaintiff in Mumbai. However, the Defendant Nos. 1 and 3 have their registered office outside Mumbai. Accordingly, I am satisfied that, a material part of the cause of action having arisen within the jurisdiction of this Court, with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the proposed Suit. 2.
