Heard the learned counsel appearing for the applicant and the learned counsel for the respondent. In paragraph-3 of the affidavit in support of notice of motion taken out by the applicant (appellant), reasons for absence of the advocate for the appellant on both days have been set out. In view of the said reasons, a case for restoration is made out. 2.

Accordingly, notice of motion is made absolute in terms of prayer clause (a). The restored appeal be fixed for admission under the caption of fresh admission on 4th December 2017. (A.K.MENON, J.) (A.S.OKA, J.)
