...Respondents

Mr. K. P. Anilkumar, for the Applicant in CHSW 191/2013. Mr. Ashok D. Shetty, for the Petitioner in both Writ Petitions. Mr. Y. R. Mishra, a/w Mr. N. R. Prajapati, for the Respondents, Ms. S. V. Bharucha, a/w Mr. Rui Rodrigues, for Respondent nos.1 & 4 in WP No.1997/2014.

Mr. Arsh Mishra, a/w Ms. Kavita Anchan, I/b M/s. M. V. Kini & Co., for Respondent no.3 in WP No.1997/2014.

CORAM:

B. R. GAVAI & N. J. JAMADAR, JJ DATED:

3rd January, 2019 PC:- 1.

The Chamber Summons is taken out for deleting the name of Mr. K. V. Jagannatha Rao as the Petitioner and, in the alternative, for allowing the applicant, Mr. Sanjay Lazar, General Secretary, to be added as Respondent no.9 in the present petition.

2.

Mr. Shetty, the learned Counsel appearing for the Petitioner vehemently opposes the Chamber Summons. 3.

It appears that there is dispute between the office bearers of the Union. However, insofar as the issues in the petition are 1/2

901-CHS191-13.DOC concerned both the petitioner and the applicant espouse the same cause. In that view of the matter, we find that the presence of the present applicant would assist the Court in proper adjudication of the dispute between the parties. In that view of the matter, we are inclined to allow prayer clause (b) in the Chamber Summons.

4.

This Chamber Summons is made absolute in terms of prayer clause (b).

5.

Amendment to be carried out within one week from today and amended copy be served to the Respondents. [N. J. JAMADAR, J.] [B. R. GAVAI, J.] 2/2
