This Notice of Motion was filed by the Plaintiffs on the apprehension that certain third party rights were being created in respect of the film Will You Marry Me in favour of the Respondent. The Respondent to the Notice of Motion, Shemaroo Entertainment Limited ("Shemaroo"), has replied to the Plaintiffs' Advocate clarifying that it has not acquired any rights in this film. The letter confirms that Shemaroo issued a public notice 20th September 2016
205-NMS2289-16.DOC in a Trade Magazine. That notice triggered the Plaintiffs' Advocate's letter of 23rd August 2016, upon which Shemaroo stopped the process and decided not to acquire any rights in the film.

Mr. Mahadgut appears for the Respondent. A copy of the letter dated 19th September 2016 from Shemaroo to Mulla & Mulla is taken on record and marked "X" for identification. The statements in the letter and which are reiterated by Mr. Mahadgut, on instructions, are accepted.

In view of this, the Notice of Motion is infructuous and disposed as such.
