The Petitioner has come before the Court after issuance of notice under section 13(2) of the SARFAESI Act. It is an admitted position that section 13(4) notice has not so far been issued. 2.

We record the statement of the learned Counsel for the Respondent-Bank that notice under section 13(4) of the SARFAESI Act shall be issued within a period of four weeks from today. After such notice under section 13(4) is issued, the Petitioner would have a remedy before the DRT.
