The observations of the Company Law Board in para 69 commencing from the words "Yet, it is expected" and ending with the words "mind the paramount interest of the Company" are not considered by this Court whilst dismissing Company Appeal No. 31 of 2015. The rights and contentions of both the parties in Company Appeal No. 31 of 2015 in connection with the above observations and particularly relating to the appointment of Board of Directors, are kept open, to be agitated in Company Appeal No. 54 of 2015.
