None appears for the Petitioner. We have perused the Affidavit-in-Reply filed by Shri. Deepak Vasudeo Kamat, Assistant Commissioner (Mkts) of Mumbai Municipal Corporation.

Apart from the fact that with the passage of time, the petition may not survives, there is a statement in the said Affidavit-in-Reply that Tender process was canceled by a letter dated 28th September 2006. Hence, nothing survives in the petition. The petition is rejected. Rule is discharged with no order as to costs.
