The above Suit was originally filed by Harit Sheth as power of attorney holder of Jethalal Hirji Shah and Hemraj S. Shah. Mr. Harit Sheth is also the executor of the Wills executed by Jethalal Hirji Shah and Hemraj S. Shah. Both Jethalal Hirji Shah and Hemraj S. Shah have passed away leaving behind their respective Wills which have been probated. In view thereof, Harit Sheth is allowed to be shown as Plaintiff in the Suit in his capacity of the Executor of the probated wills of Jethalal Hirji Shah and Hemraj S. Shah. Necessary amendments to be carried out within a period of one week from today. Re-verification is dispensed with. The Chamber Summons is accordingly disposed off.
