The counsel appearing for the respondent confirms whatever is stated in the affidavit in support and states that the respondent has no objection.
In the circumstances, the chamber summons is allowed and accordingly disposed of in terms of prayer clause - (a). Gauri Gaekwad
21.CHS-1075-2015.doc The amendment to be carried out and copy of the amended plaint to be served within two weeks from today. The counsel appearing for the respondent, who is now substituted as defendant waives service of writ of summons. Within four weeks of receiving the copy of the amended plaint, the defendant shall file the written statement and serve a copy thereof upon the plaintiffs.
The suit be listed for issues on 23rd January, 2017. In the meanwhile, parties shall also file their respective affidavit of documents, complete discovery and inspection and also file and exchange their statement of admission and denial with reasons for denial.
