The Petition is for leave under Clause XII of the Letters Patent. The Suit is in respect of a sale agreement dated 21st February 2008; a development agreement dated 25th February 2010 and a conveyance dated 9th December 2014. The property is at Kurla, Mumbai. Respondents Nos. 3 and 4 are outside the jurisdiction of this Court. A material part of cause of action has arisen within the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit. 2.
