The above petition has been filed seeking a direction that Respondent no. 2 i.e. the learned Arbitrator be directed to decide the preliminary issue with regard to the existence of arbitration agreement between Petitioner no. 1 and Respondent no. 2.

2) In our view, the above petition is misconceived. It is for the petitioner to adopt appropriate proceedings under the Arbitration and Conciliation Act, 1996 for redressal of its grievances.
