This Petition for leave under Clause XII of the Letters Patent is filed only because of an objection taken by the Registry that the Defendant is outside the jurisdiction of this Court. The objection is not properly raised in view of the provisions of Section 134 of the Trade Marks Act. No leave is required. This Court has jurisdiction to entertain and try the Suit since the registered office of the Plaintiff is in Mumbai.
