This Application is taken out to delete Plaintiff No.3 from the array of Plaintiffs as Plaintiff No.3 passed away on 14 January 2022. Plaintiff No.3 - Fali Phirozeshaw Sarkari was impleaded as Plaintiff in the capacity of the trustee of R.D.Sethna Scholarship Fund, and not in his personal capacity. 3.

The learned Counsel for the Defendants submit that they do not have any objection to allow the Application.

Hence, the Application stands allowed in terms of prayer clause (a). 5.

Necessary amendment be carried out in accordance with the Schedule (Exhibit B) appended to the Application.
