This chamber summons is taken out by the applicant/plaintiff for leave to amend the plaint and notice of motion No.770 of 2014. Though the affidavit in reply has been filed opposing the chamber summons, the counsel for the defendant, after the matter progressed for some time, very fairly states that if the Court was inclined to allow the chamber summons for the reasons mentioned in the affidavit in support, then the rights and contentions of the defendant should be kept open.

Amendment to be carried out and a copy served on or before 28th January 2014. Should the defendant wish to file additional written statement, if any, or amend the existing written statement and also wish to file further affidavit in reply to the notice of motion, the same to be done and a copy served on or before 18th February 2015.
Stand over to 24th February 2015 for hearing the notice of motion no.770 of 2014.
