The parties have filed a joint declaration whereby the parties have agreed to refer their disputes as contained in this petition as well as in suit no.363 of 2018 pending before the City Civil Court, Bombay to arbitration to Mr. Rakesh Reddy, an advocate practicing in this Court. The joint declaration is taken on record and marked "X" for identification and for ease of reference a scanned copy of the same is reproduced below : Gauri Gaekwad

2/2 5.CP-763-2016.doc Mr. Rakesh Reddy, Advocate is appointed as Sole Arbitrator to arbitrate on all disputes arising out of or in connection with or relating to the underlying dispute in the company petition as well as suit no.363 of 2018 pending in City Civil Court, Bombay.

Mr. Reddy to make disclosure in writing under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act 1956 to the parties directly within one week of receiving a communication from the advocates forwarding a copy of this order.

The fees and expenses of the Arbitrator shall be shared equally between the parties and the same will be subject matter of costs in the arbitration.

Mr. Shroff, counsel for petitioner undertakes to withdraw the suit no.363 of 2018 within two weeks from today. Undertaking accepted. Petition accordingly stands disposed.
