This Notice of Motion is taken out by the Applicant/Plaintiff in a patent infringement suit. The Defendants were absent on the last occasion despite service. Only as a last chance the matter was stood over to today's date. Even today when the matter is called out none appears for the Defendants. By a detailed ad-interim order dated 10 October 2014, ad-interim reliefs have been granted to the Plaintiff in terms of prayer clause (a) of the Notice of Motion. This Court has considered the averments of the Plaintiff and recorded that an overwhelming prima facie case has been made out by the Plaintiff. The case made out by the Plaintiff, not having been controverted by the Defendants even as of date, the Notice of Motion is made absolute in terms of prayer clause (a). There shall be no order as to costs.
