Learned counsel appearing for the petitioner tenders a letter dated 5th April,2018 from the petitioner instructing the learned advocate on record to withdraw the arbitration petition as the matter is settled out of court. Letter dated 5th April,2018 is taken on record and is marked 'X' for identification. Arbitration Petition No.1270 of 2016 is dismissed as withdrawn in view of out of court settlement arrived at between the parties. No order as to costs.

In view of the withdrawal of the Arbitration Petition No.1270 of 2016, Notice of Motion No. 955 of 2017 does not survive and is accordingly disposed of.

Refund of court fees if any, as per rules.

The respondent is granted liberty to withdraw the amount deposited by the petitioner in this court pursuant to the order dated 12th January, 2018 read with orders dated 7th March,2018 and 23rd March,2018 unconditionally in view of the matter having been settled. 5.
