Heard learned counsel for the applicant.

By this application, the applicant / petitioner seeks post grant amendment of probate issued on 15th November, 2019. By way of the amendment, the applicant seeks to amend the original schedule so as to incorporate correct description of the property at serial No. 4 of the schedule.

The proposed amendment is at Exhibit "B" to the present application.

This Court has perused the material on record. In the Shrikant Malani

909.IA.3448.2023.doc interest of justice, the application is allowed in terms of prayer clauses (a) and (b), which read as follows :

"(a) That the Applicant may kindly be allowed to amend Schedule II annexed to the Petition as per "Schedule of Amendment" annexed to this Interim Application, with consequential amendment, if any, in the Petition.

(b) That after amendment of Schedule II annexed to the Petition, as sought in prayer (a), is carried out, Testamentary Department may be direct to amend Probate issued on 15th November 2019 in above Petition, as per amended Petition."

The amendment be carried out within two weeks from today. Re-verification is dispensed with.

The department shall take consequential steps in the matter.
