The application is disposed of by directing the Official Liquidator to forthwith take steps to procure statement of affairs from the ex-directors of the company in liquidation. The Liquidator shall seek a statement of affairs from the directors within a period of six weeks from today. If within this period, the statement of affairs is not forthcoming, the Liquidator is directed to file a criminal complaint under Section 454 of the Companies Act, 1956 against the ex-directors without reference to this Court.

If the whereabouts of the ex-directors are either not available or if the ex-directors refused to accept notice so as to evade the same, the Liquidator may seek police assistance in this behalf. The Official Liquidator may also take assistance from the Applicant for this purpose. (S.C. Gupte, J.)
