Mr.Udaipuri, learned counsel for the petitioner after arguing the matter at great length on instruction seeks liberty to withdraw this petition. Though in my view the petitioner has been rightly advised now to withdraw this petition, withdrawal of petition cannot be allowed unconditionally. The company petition is accordingly dismissed as withdrawn with cost quantified at Rs.50,000/- which shall be paid by the petitioner to the respondent within two weeks from today. (R.D.DHANUKA, J.)
