Learned Counsel for the parties tender Consent Terms in Suit No.917/2013. By these Consent Terms, Defendant No.3 is sought to be deleted from the array of parties and the suit settled as between the Plaintiff and Defendant Nos.1 and 2. So also, the companion suit, namely, Suit No.129/2014, is proposed to be withdrawn by the Plaintiffs in that suit in view of the present Consent Terms.

The Consent Terms are taken on record, marked "X" for identification. The statements / undertakings contained therein are accepted. Defendant No.3 is deleted from the array of parties. The suit is disposed of in terms of the Consent Terms as between the Plaintiff and Defendant Nos.1 and 2. No order as to costs. Refund of Court fees in accordance with the applicable

Suit No.129/2014 is dismissed as withdrawn. There shall be no order as to costs. Refund of Court fees in accordance with the applicable Rules. Parties to act upon the authenticated copies of the order and the Consent Terms.
