Learned Counsel for the Defendant tenders the vakalatnama signed by the Defendant in favour of the Advocate. Leave granted to the Plaintiff under Clause XIV of the Letters Patent to combine the causes of action of infringement and passing off in terms of prayer clause (a) of the Leave Petition.

Learned Counsel for the parties tender Consent Terms duly signed by the authorized representatives of the parties and also their Advocates. A decree on admission in favour of the Plaintiff is sought in terms of the Consent Terms. The Consent Terms are taken on record, marked "X" for identification. The statements and undertakings contained therein are accepted. There will be a decree on admission in terms of the Consent Terms. There shall be no order as to costs.

In view of the disposal of the suit, nothing survives in the Notice of
