Both the counsel submit that the matter is settled out of Court. They have tendered Consent Terms dated 06th November, 2017, duly signed by parties as well as their advocates. Consent Terms are taken on record and marked 'X' for identification.

Liberty granted to the plaintiff to carry out amendment in the cause title of the plaint during the course of the day. Reverfication is dismissed. Both the counsel submit that the defendants are present in Court as follows:

i) Deepak Shivdasani- Defendant No.1 ii) Deepak Shivdasani-Partner of Defendant No.4.

iii) Vijay Nair-Partner of Defendant No.3.

Suit stands disposed of in terms of Consent Terms. No order as to costs. Consent Terms to be treated part and parcel of decree.

Refund of Court fees as per rules.

In view of disposal of suit in terms of Consent Terms, nothing survives in pending notice of motion. Accordingly, motion stands disposed of as infructuous. No order as to costs.
