The company application seeks recall and setting aside of an order dismissing the company appeal and restoration of the appeal on file. The company appeal was dismissed for want of prosecution on 16 June 2014. Learned Counsel for the Respondents opposes the application. The application has set out the circumstances in which the appeal came to be dismissed. For reasons stated in the affidavit in support of the company application, the application is allowed in terms of prayer clause (a). The Appellant is permitted to remove the office objections within a period of four weeks from today, failing which the appeal shall stand dismissed under Rule 986 of the Bombay High Court (Original Side) Rules.
