By an order dated 14th November, 2017, the disputes and differences between both the parties were, by consent, referred to the Sole Arbitration of Mr Rohan Rajadhyaksha, an advocate practicing in this Court. There were also further directions given in the said order. One of the directions was that the Plaintiff was to file the disclosures by the Arbitrator as contemplated under Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996 ("the said Act") Pg 1 of 2

2.coms.6.2008.doc within a period of one week from 14th November, 2017. Solely for this purpose, the matter was kept on board today. Today, the disclosures as contemplated under Section 11(8) read with Section 12(1) of the said Act has been tendered by the Plaintiff and marked "X" for identification. Both the parties are satisfied with the disclosures made.

In this view of the matter, as directed in the order dated 14th November, 2017, all disputes and differences arising out of, in connection with and/or relating to the Memorandum of Undertaking dated 13th February, 2010 and the Agreement dated 28th March, 2013 , being the subject matter of the above Commercial Suit are referred, by consent of parties, to the Sole Arbitration of Mr Rohan Rajadhyaksha, an advocate practicing in this Court. The suit is disposed of in the aforesaid terms. Refund of court fees, if any, as per rules. No costs. ( B. P. COLABAWALLA, J. ) Pg 2 of 2
