Parties agree to refer all their disputes to the sole arbitration of Mr Vishal Kanade, Learned Advocate of this Court. His signed statement of disclosure under Section 11(8) read with Section 12(1) of the Arbitration & Conciliation Act 1996 is taken on record and marked "X" for identification.

Parties are agreed that the schedule for filing before the learned Sole Arbitrator may be fixed as follows. 19th January 2017

910-NMS2316-16.DOC (a) Statement of Claim along with compilation of documents is to be filed and served on or before 24th February 2017;

(b) Inspection to be completed on or before 10th March 2017;

(c) Reply to the Statement of Claim along with compilation of documents is to be filed and served by the Defendants on or before 17th April 2017;

(d) Inspection of the Defendants documents is to be completed on or before 28th April 2017;

(e) Meeting before the learned Sole Arbitrator to fix a schedule for further hearing/trial to be held in the first week of May 2017.

I am making it clear that the parties in the arbitration will strictly adhere to the schedule as finalized and settled. They undertake not to seek any extensions of time, and these undertakings as accepted as undertakings to Court. 4.

All contentions are expressly kept open.

The Notice of Motion and the Suit are disposed of in these terms. Refund of court fee in accordance with the Rules. (G. S. PATEL, J.) 19th January 2017
