The Petition was accepted on 23rd January 2013. A proclamation was ultimately issued after some extensions. None have come forward. Although none appears for the Petitioner, I notice that there is an Affidavit on record proving service of proclamation. There is no opposition on file to this Petition. 2.
The Petitioner seeks a Legal Heirship Certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of one Mangesh Baban Bansode, who is said to have died intestate in Mumbai where he was ordinarily resident, on 5th May 2009. A copy of his death certificate is annexed. The deceased was survived by the persons whose names are mentioned in the tabulation below paragraph 4 of the petition.

The Petition is brought by the adopted son of the deceased. The widow Smt. Anita Bansode has consented. Smt. Anita and deceased had three children, namely, a married daughter, a minor and son and a minor daughter. The minors are under the care and custody of the widow who granted consent. None having come forward, there is no impediment to the grant of reliefs. As regards the Petitioner himself, a copy of his Deed of Adoption is at Exhibit "C" to the Petition.

The petition is made absolute in terms of prayer clause (a), which reads thus:
"(a)That a Legal Heirship Certificate Certifying that the Petitioner along with the Heirs mentioned herein above are the only heirs and legal representative of the said deceased under the Provision of Bombay Regulation Act VIII of 1827."
